While there are seven grounds for seeking a divorce, Insupportability, or what is referred to commonly as "no fault," is by-far the most-common reason for granting a divorce. Section 6.001 of the Texas Family Code states, "On the petition of either party to a marriage, the court may grant a divorce without regard to fault if the marriage has become insupportable because of discord or conflict of personalities that destroys the letitimate ends of the marital relationship and prevents any reasonable expectation of reconciliation." While reasonable expectation of reconciliation is a recognized defense to a suit for divorce, no known case exists citing this as a reason for refusing to grant a divorce. Before seeking a divorce you should make a serious attempt to reconcile your marriage, including seeking the advice of professional marital counselors.
